Terms & Conditions
The Work, Stay, Play program is offered by LyLo Operations NZ Ltd trading as LyLo (the “Company”). The program is designed to support participants who have or are applying to the New Zealand government for a working holiday visa and who will be arriving in New Zealand to begin their 1 year working holiday.
Please read this document carefully. By signing the declaration on the application form or by taking part in the Work, Stay, Play program you are confirming you have read and agree to the terms and conditions and understand that they are binding on you and that your adherence to them is imperative. In addition, you are confirming that the statements contained in this document are accurate to the best of your knowledge, and that you understand and accept the terms and conditions.
This English language version of the contract is the binding contract between you and the Company.
By joining the program you are bound by the Company’s general terms and conditions of booking accommodation, staying at LyLo and our privacy policy which are listed here:
1. Program inclusions
If you are booked on to the 4-day programme you will receive:
- 3-day orientation program at LyLo Auckland, comprising a mix of group and 1:1 sessions
- 3 nights LyLo Auckland Pod accommodation
- Super shuttle Auckland Airport to LyLo (one way only)
- Welcome activities
- Pre-departure online orientation
If you are booked on to the 9-day programme you will receive:
- 3-day orientation program at LyLo Auckland, comprising a mix of group and 1:1 sessions
- 6 nights LyLo Pod accommodation
- 2 nights Bay of Islands accommodation and Kiwi Experience coach return to Bay of Islands
- Super shuttle Auckland Airport to LyLo (one way only)
- Welcome activities
- Pre-departure online orientation
2. Orientation Only
The Company is the provider of the orientation program that you have booked through a booking agent at one of the Company’s partner agencies. For all program costs, deposit, cancellation conditions and advice on and eligibility for a working holiday visa please refer to your booking agent. The Company’s role is limited to fulfilment as the provider of the orientation program once you arrive in New Zealand and one online orientation session prior to arrival.
3. Working Holiday Visa
- It is up to the participant and their booking agent to ensure they meet the eligibility criteria and apply for their own working holiday visa.
- It is important to be aware of cancellation conditions that apply through your partner agent and ensure you have allowed enough time to obtain the working holiday visa before your date of travel to meet your chosen orientation package.
4. Job support
- It is up to the participant to find their own job. It is recommended you do research on the area you are travelling to, to ensure you are travelling to an area where placements are readily available.
- The Company provides advice on preparing a curriculum vitae, and can advise on places to look for a job, but is not involved in obtaining interviews or job placements for participants.
5. Limitation of liability
5.1 You understand and accept that there are risks associated with traveling to and temporarily residing in a foreign country. Such travel involves foreseen and unforeseen risks that are inherently dangerous, all of which are accepted and assumed by you. The Company and its directors, employees, managers and shareholders are not liable for any loss that you may suffer caused by external or third-party acts or events.
5.2 You acknowledge and agree that unless required by New Zealand law (including under the Consumer Guarantees Act 1993) the Work, Stay, Play program is provided “as is” without warranties of any kind, express or implied. You also acknowledge that you take part in the Work, Stay, Play Program at your own risk. To the extent permitted by law (and without limiting the Consumer Guarantees Act 1993) the Company and you each:
- exclude liability for any indirect or consequential loss or damage including loss of profits and loss of revenue; and
- limit their liability to any one or more of the following:
- in relation to goods, replacing or repairing the goods or supplying an equivalent item, or paying the costs or replacing, repairing or hiring an equivalent item; or
- in relation to services, the re-supply of the services or payment of the cost of having the services re-supplied.
5.3 Each party must take reasonable steps to mitigate any loss it suffers or incurs.
6. Immigration
It is your responsibility to ensure that you are allowed to be in New Zealand to undertake your program.
7. Travel and Documentation
7.1 We do not arrange any flights to New Zealand and these are entirely your responsibility and at your own cost.
